DUJ और प्रेस क्लब ने ‘द कारवां’ के उन पत्रकारों के ख़िलाफ़ एफ़आईआर की निंदा की जिन पर 2020 में हमला हुआ

नई दिल्ली: प्रेस क्लब ऑफ इंडिया (पीसीआई) और डीयूजे ने उत्तर-पूर्वी दिल्ली के भजनपुरा पुलिस स्टेशन में पत्रिका द कारवां के पत्रकारों के खिलाफ़ कथित तौर पर पत्रकारों पर हमले के चार साल पुराने मामले में गंभीर धाराओं के तहत दर्ज की गई एफआईआर की कड़ी निंदा की है। पत्रकारों पर लगाई गई धाराओं में 153 ए (सांप्रदायिक दुश्मनी को बढ़ावा देना) और 354 (महिला की गरिमा को ठेस पहुंचाना) शामिल हैं।

कारवां पत्रिका ने एक बयान में कहा कि उन्हें एफआईआर की प्रमाणित प्रति नहीं मिली है, जिसे न देने के लिए एफआईआर की “संवेदनशील प्रकृति” का हवाला दिया गया है।

बयान में कहा गया है कि उसके पत्रकारों के खिलाफ मामले “झूठे और मनगढ़ंत” हैं, और “उनकी रिपोर्टिंग को दबाने का प्रयास” है।

बयान में आगे कहा गया है कि, "यह भी बेहद चिंताजनक है कि हमारे पत्रकार, जो दिल्ली हिंसा के एक शिकायतकर्ता द्वारा पुलिस पर लगाए गए आरोपों की रिपोर्टिंग कर रहे थे, अब उसी पुलिस स्टेशन में एफआईआर का सामना कर रहे हैं।" साथ ही बयान में कहा गया है कि वे जांच में शामिल हो गए हैं और कानून की उचित प्रक्रिया का पूरी तरह से पालन कर रहे हैं। "हम इन झूठे आरोपों को चुनौती देने के लिए कानून के तहत अपने अधिकारों का प्रयोग करेंगे...।" 

घटना का जिक्र करते हुए पत्रिका ने कहा है कि 11 अगस्त, 2020 को पूर्वोत्तर दिल्ली के सुभाष मोहल्ला इलाके में भीड़ ने तीन पत्रकारों- शाहिद तांत्रे, प्रभजीत सिंह और एक महिला पत्रकार पर हमला किया था।

इसमें आरोप लगाया गया है कि "पत्रकारों को सांप्रदायिक तौर पर गालियां दी गईं और उन्हें जान से मारने की धमकी दी गई; महिला पत्रकार का यौन उत्पीड़न किया गया। खुद को भारतीय जनता पार्टी का "महासचिव" बताने वाले एक व्यक्ति ने तांत्रे की मुस्लिम पहचान जानने के बाद हमारे कर्मचारियों पर हमला किया था।" 

उस समय भी प्रेस क्लब ऑफ इंडिया ने पत्रकारों पर हमले को लेकर गंभीर चिंता जताई थी और एफआईआर के साथ-साथ न्यायिक जांच की मांग की थी।

प्रेस क्लब ऑफ इंडिया ने एक बयान में कहा है कि, "सबसे ज़्यादा परेशान करने वाली बात यह है कि पुलिस के ख़िलाफ़ आरोपों की रिपोर्टिंग करने वाले पत्रकारों पर हमला किया गया और अब उसी पुलिस स्टेशन में उनके खिलाफ एफ़आईआर दर्ज की गई है। उसी पुलिस ने कारवां के पत्रकारों की एफ़आईआर पर कोई कार्रवाई नहीं की थी।"

प्रेस क्लब ऑफ इंडिया ने दिल्ली पुलिस से “पत्रकारों के खिलाफ एफआईआर रोकने और कारवां के पत्रकारों द्वारा दर्ज एफआईआर की उचित जांच करने” का आग्रह किया है और दिल्ली उच्च न्यायालय से जांच की निगरानी करने का भी आग्रह किया है ताकि प्रेस की आज़ादी पर हमला करने के लिए सत्ता का दुरुपयोग न किया जा सके।

दिल्ली यूनियन ऑफ जर्नलिस्ट्स ने एक बयान जारी कर कहा है कि, वह इस खबर से स्तब्ध है कि दिल्ली पुलिस ने कारवां पत्रिका के लिए रिपोर्टिंग करने वाले तीन पत्रकारों पर चार साल पहले हुई एक घटना के लिए मुकदमा चलाने का फैसला किया है। कारवां के पत्रकार रिपोर्टर हैं, दंगाई नहीं।

डीयूजे ने मांग की है कि एफआईआर की 'जांच' रोकी जाए और पूरे प्रकरण की दिल्ली उच्च न्यायालय द्वारा जांच कराई जाए। बयान में आगे कहा गया है कि, हम एफआईआर को प्रेस की आज़ादी पर हमला मानते हैं और खास तौर पर कारवां पर हमला मानते हैं जो अपनी साहसिक और स्वतंत्र रिपोर्टिंग, विश्लेषण और खुलासे के लिए जाना जाता है।

PRESS STATEMENT

The Press Club of India strongly condemns the FIR against journalists of The Caravan under serious sections such as IPC 354 and 153(A) at the Bhajanpura Police Station in North East Delhi.

In August of 2020, the journalists concerned were reporting on allegations against the police officials at Bhajanpura PS in Delhi and on communal tensions in the North East Delhi area. During the course of their work, they had faced a life-threatening communal attack and sexual harassment by a mob in the area. At the time, the PCI had raised serious concerns about the attack on the journalists and demanded an FIR as well as a judicial probe.

Instead of holding the attackers to account, the Delhi Police not only delayed the registration of the FIR but has taken forward an investigation against the journalists instead. The details of the FIR against the journalists are completely counter to the facts of the incident, which were widely reported by the media. It is extremely concerning that the police did not inform The Caravan of this FIR for four years.

Most disturbing is the fact that the journalists who were reporting on allegations against the police were attacked and are now facing a serious FIR at the same police station. The same police has not followed up on the FIR by the Caravan journalists.

This is a clear attempt to suppress journalists and to throttle press freedom. The PCI extends its full support to the journalists of The Caravan who are being persecuted simply for carrying out their journalistic duty. We also condemn the biased and vindictive conduct of the Delhi Police.
We call on the Delhi Police to carry out its duty fairly and without bias, to halt the FIR against the journalists and to properly investigate the FIR by the Caravan journalists. We also call on the Delhi High Court to monitor the investigations so that power is not misused to attack press freedom.

DUJ Statement
The Delhi Union of Journalists is shocked at the news that Delhi Police has chosen to prosecute three journalists, who were reporting for the Caravan journal, for an incident that occurred four years ago.  The Caravan journalists are reporters, not rioters. 

The journalists, two young men and a young woman, had been attacked by a communal mob in August 2020 while investigating a complaint against the Bhajanpura police. 

The journalists filed an FIR about the mob violence but the police did not pursue their complaint for four years. Instead it is now prosecuting three journalists under serious non-bailable charges under a counter FIR. 
 
The non-bailable charges under Section 354 and 153 A of the IPC are for alleged assault and for promoting enmity between different groups on grounds of religion.

The DUJ demands that the 'investigation' into the FIR be halted and an inquiry be conducted by the Delhi High Court into the entire episode. We view the FIR as an assault on the freedom of the press and particularly an assault on Caravan which is reputed for its bold and independent reportage, analyses and exposes.
